Amended and Restated Policy on Fishing and the Prohibition of Hunting, Trapping, Removal of Plant or Animal Life, Discharge of Firearms, Camping and Use of Motorized Transportation
1. Prohibited Activities:
Unless a valid and current written permit to the contrary has been issued by Northern Palm Beach County Improvement District (“Northern”) and such written permit is on the person claiming to have received said permit, the following prohibitions are applicable to all Northern owned real property (the “Real Property Interests”):
(a) No person shall hunt, trap, discharge a firearm, use archery equipment, remove plants or wildlife or retrieve dead or wounded game animals from, on or within the boundaries of Northern Real Property Interests at any time.
(b) No person shall take, set snares, traps, or nets, install hunting blinds, or use archery equipment on or within the boundaries of Northern Real Property Interests at any time.
(c) No person shall establish or maintain a campsite, erect tents, or sleep outdoors on or within the boundaries of Northern Real Property Interests at any time.
(d) No person shall build, attend, maintain, or use a campfire or open flame on or within the boundaries of Northern Real Property Interests at any time.
(e) No person shall operate any gas or electric powered means of transportation (excluding motorized wheelchairs) within the boundaries of Northern Real Property Interests at any time
2. Fishing:
(a) The use of boats, kayaks, canoes, or other floatable devices for fishing is prohibited in all Northern waterways, lakes, canals, impoundments and swales for fishing or other activities.
(b) Commercial fishing, or the buying or selling of fish caught in any Northern waterways, lakes, canals, impoundments and swales is prohibited.
(c) Sport fishing is allowed in all Northern waterways, lakes, canals, impoundments and swales except where specifically prohibited by Northern signage.
(d) The use of a troll line for fishing is expressly forbidden in any Northern Palm Beach County Improvement District waterways, lakes, canals, impoundments and swales. Set cane poles are permitted provided the user thereof is present and attends to them during their usage.
(e) All applicable Florida Fish and Wildlife Conservation Commission (FWC) rules and regulations shall apply.
(f) We encourage “catch and release”, but it is not a requirement as long as the angler is complying with all applicable FWC rules and regulations.
(g) Fishing nets are prohibited in any Northern Palm Beach County Improvement District waterways, lakes, canals, impoundments and swales.
3. Access Restrictions: Entry onto any Northern Palm Beach County Improvement District real property for the purpose of any of the aforementioned prohibited activities is considered trespassing. Permission granted for other activities (e.g., hiking, birdwatching) does not imply permission to allow the above prohibited activities.
4. Enforcement: Unauthorized persons violating the above Prohibited Activities or Fishing prohibitions will be asked to leave immediately and may be subject to prosecution under State of Florida laws, rules and regulations, Palm Beach County Ordinances or Municipal Ordinances.
